Privacy Collection Notice
In this notice, the expressions we, us and our refer to TomKat Global Solutions Pty Ltd (ABN 95 630 878 045) and our Related Bodies Corporate (as defined in the Corporations Act 2001 (Cth)).
We are committed to protecting the privacy of individuals and their: personal information (as defined in the Privacy Act 1988 (Cth) (Privacy Act)) in respect of individuals within Australia; or personal data (as defined in the applicable General Data Protection Regulation (GDPR)) in respect of individuals within the European Economic Area (EEA) or the United Kingdom (UK).
Please read this notice carefully as it will have important consequences for you in relation to the collection, use and disclosure of your personal information or personal data provided to TomKat.

2 TomKat will collect your personal information directly from you (including any unsolicited information or data you may provide in the body of your enquiry, or when using the app). In certain circumstances, TomKat may be required to collect your personal information from third parties, depending on the nature of your enquiry.
3 TomKat collects your personal information for the primary purpose of supplying our products and services to you and responding to your enquiry. You agree to your personal information being collected and used for, and in connection with, these purposes and any other purpose described in our Privacy Policy. If we do not collect your personal information in connection with the purposes outlined, then we may be unable to supply you with our products and services or respond to your enquiry.
4 We may disclose your personal information to our related entities, third party service providers, and other organisations set out in our Privacy Policy, for the purposes described in paragraph 3.
5 It is possible that some of the information collected may be disclosed to TomKat’s related bodies corporate or service providers outside of Australia, as the case may be. You consent to your information being disclosed to a destination outside Australia for this purpose, and you understand and acknowledge that the Australian Privacy Principle 8.1 will not apply to such disclosures of your personal information outside of the relevant jurisdiction.
6 TomKat’s Privacy Policy sets out how you can access and correct any of your personal information collected under this notice as well as to how you can make a complaint if TomKat has breached the Privacy Law in the handling of your Personal Information. By continuing with your enquiry, you indicate that you: have read this notice; acknowledge that your personal information will be collected, used and disclosed in accordance with this notice and as otherwise detailed in TomKat’s Privacy Policy, to the extent it is necessary; and give your voluntary express consent to TomKat collecting, using, storing, disclosing and disposing of your personal information in this manner.

If you are a resident of the EEA or UK and we collect personal data from you, you have additional “data subject rights” in relation to personal data about you, as described in our Privacy Policy. 7 We do not engage in automated decision-making (such as profiling) in respect of your personal data.
If you have any concerns in relation to TomKat’s collection or processing of your personal data pursuant to this notice, then you also have a right to complain to the data protection authority in your country (within the meaning of the GDPR)
